SellBusiness.ca ("we," "us," "our") is an online business and commercial real estate marketplace operated by Aakash Jangra, a registered real estate Salesperson with Home Choice Realty Inc., Brokerage, registered with the Real Estate Council of Ontario (RECO) under the Trust in Real Estate Services Act, 2002 (TRESA). Our platform facilitates the listing, discovery, and transaction of businesses and commercial properties across Ontario and Canada.
We are members of the Canadian Real Estate Association (CREA) and are bound by CREA's rules governing use of MLS® Systems and the Data Distribution Facility (DDF®). Applicable TREB/PropTx MLS® Rules (effective December 2, 2024) also govern our use of Toronto-region listing data.

5. MLS® Listing Data - Important Disclosures
SellBusiness.ca may display listing information sourced from the MLS® System operated by CREA, PropTx (formerly TREB), and other real estate boards. The following disclosures apply to all MLS®-sourced data.

6. Non-Registrant (For-Sale-by-Owner) Sellers
SellBusiness.ca accepts exclusive listings from private sellers who are not registered real estate registrants (e.g., business owners selling their own business or commercial property directly). The following special terms apply.
6.1 Consent & Disclosure Requirement
By submitting a listing, non-registrant sellers expressly consent to:
Publication of their business name, location (city/region), asking price, and business description on SellBusiness.ca and partner platforms
Their contact information being shared with qualified buyer inquiries facilitated through our platform
Retention of listing data for a minimum of 7 years for regulatory recordkeeping
Their listing information potentially appearing in CREA's DDF® or third-party aggregator feeds (where applicable and consented to)
6.2 Privacy Protections for Private Sellers
Personal home addresses and direct phone numbers will not be published publicly without explicit written consent
Seller identity is not disclosed to buyers prior to the execution of a Non-Disclosure Agreement (NDA) or confidentiality agreement
Financial data submitted (e.g., revenue, EBITDA) is shared only with qualified, pre-screened buyer inquiries
6.3 What Non-Registrant Sellers Cannot Do
Important: Private (non-registrant) sellers are not permitted to post residential property listings on MLS® without the involvement of a licensed real estate registrant. SellBusiness.ca does not circumvent MLS® rules. Any listing submitted by a private individual that constitutes a residential property listing will require co-operation with a registered brokerage.
6.4 Third-Party Agent Submissions
When a registered REALTOR® or real estate agent submits a listing on behalf of a client, that agent represents and warrants that:
They hold a current, valid RECO registration
They have obtained written authorization from their client (the seller) to submit and publicly market the listing
They have satisfied all applicable TRESA disclosure obligations
The listing complies with applicable MLS® Rules and CREA policies
6B. FINTRAC & Anti-Money Laundering (AML) Obligations
As a registered real estate salesperson, Aakash Jangra is a reporting entity under Canada's Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and is subject to FINTRAC oversight. This applies to real estate transactions facilitated through or arising from SellBusiness.ca. Effective October 1, 2025, updated FINTRAC obligations for real estate professionals are in force.
What This Means for You
Identity Verification: We are legally required to verify the identity of all clients and unrepresented parties to a real estate transaction before completion. This applies to both buyers and sellers involved in any real estate trade facilitated through this platform
Unrepresented Party Verification: As of October 1, 2025, real estate salespersons must also verify the identity of unrepresented parties to a transaction - including private sellers and buyers without an agent
Large Cash Transactions: We must report to FINTRAC any receipt of $10,000 CAD or more in cash within a 24-hour period in connection with a real estate transaction
Suspicious Transaction Reports: We must report transactions where there are reasonable grounds to suspect money laundering or terrorist financing, regardless of the transaction amount
Record Keeping: Transaction records, identity verification records, and related documents must be retained for a minimum of 5 years under PCMLTFA
Your Personal Information and FINTRAC
Personal information collected for identity verification purposes (e.g., government-issued ID, name, date of birth, address) will be used exclusively to fulfill our FINTRAC obligations. This information may be disclosed to FINTRAC as required by law. It is not used for marketing and will not be shared with any third party other than as required by the PCMLTFA.
Important: Providing false identity information in connection with a real estate transaction is a federal criminal offence under the PCMLTFA. All parties to transactions facilitated through SellBusiness.ca are required to provide truthful and complete identity information when requested.
7. Sharing & Disclosure of Personal Information
We do not sell your personal information. We may share it in the following circumstances.
7.1 With Your Consent
Buyer inquiries and referrals will only receive seller contact information after you have been notified and a confidentiality process has been followed.
7.2 Service Providers
We engage trusted third-party service providers for hosting, analytics, email delivery, and payment processing. All such providers are bound by data processing agreements consistent with PIPEDA requirements.
7.3 Real Estate Boards & CREA
Listing data submitted through our platform may be transmitted to CREA's DDF® and/or PropTx/TREB IDX systems as applicable to your listing type. This is disclosed at the point of listing submission and requires your consent.
7.4 Legal Obligations
We may disclose personal information where required by law, court order, RECO investigation, or regulatory authority. Where legally permitted, we will notify you before such disclosure.
7.5 Business Transfers
In the event of a merger, acquisition, or sale of our business, personal information may be transferred to the successor entity. You will be notified of any change in control that materially affects how your information is handled.

Transaction & listing records: 7 years from transaction close or listing expiry - RECO / TRESA regulatory requirement
Seller identity & submission data: 7 years - RECO records retention rule
Marketing & inquiry contacts: Until unsubscribe or withdrawal of consent - CASL / PIPEDA consent
Website analytics & cookies: 13 months (rolling) - Legitimate interest
Inactive accounts (no transaction): 3 years from last activity, then deleted - PIPEDA proportionality principle
9. Your Privacy Rights
Under PIPEDA, you have the following rights with respect to your personal information:
Right of Access: Request a copy of the personal information we hold about you
Right to Correction: Request correction of inaccurate or incomplete information
Right to Withdraw Consent: Withdraw consent to certain uses (subject to legal or contractual obligations)
Right to Complain: Lodge a complaint with our Privacy Officer or the Office of the Privacy Commissioner of Canada (OPC)
Right to Opt-Out of Marketing: Unsubscribe from marketing communications at any time using the unsubscribe link or by contacting us

SellBusiness.ca is a commercial platform intended for adults aged 18 and over. We do not knowingly collect personal information from individuals under the age of 18. If you believe a minor has submitted personal information through our platform, please contact our Privacy Officer immediately.
13. Updates to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, platform features, or applicable law. When we make material changes, we will:

Post a notice on our website homepage for 30 days
Send an email notification to registered users where required by law
